“外嫁女”土地拆遷補償糾紛及其解決路徑

摘要在村規民約的背景下，就“外嫁女”的土地拆遷補償的糾紛進行了探討，在確立集體經濟組織成員資格認定的基礎上，在民間法（村規民約）與法律發生沖突時，提出了社會治理合法化的應對措施。

AbstractThe dispute of land demolition compensation of the “outside married women” was discussed under the background of the village rules and regulations. On the basis of confirming the membership qualification of the collective economic organization， when the civil law （village regulations） and the law conflict， the social governance legalization of the response measures were put forward.

村規民約作為村民自治的一種依據，在村民治理中發揮著重要作用。而村規民約在某些程度上會對部分特殊群體的合法權利造成侵害，集體成員間的權利義務關系不明確，在對“外嫁女”土地拆遷補償的糾紛方面缺乏合法的解決依據。

婦女的地位受習慣法的影響，廣大農村地區長久存在著“嫁出去的女兒潑出去的水”這一傳統思想，“外嫁女”這類特殊群體的權益受到村規民約的制約。隨著人權意識的提升，婦女的權利也需要更多的重視和保障。在鄉村治理中，村規民約一定程度上發揮著國家法律的替代職能。當然，村規民約是民間的傳統治理與國家民主治理之間的一種互動，尤其是在對特殊主體的權益保護過程中，其公平、合法、合理的運行，也是判定村規民約有效性的一種手段，在“外嫁女”土地拆遷補償的糾紛的保障方面體現得更加突出，集體成員資格的認定是解決土地拆遷補償款糾紛的前提和關鍵。筆者分析了村規民約背景下“外嫁女”土地拆遷補償糾紛的根源，指出了“外嫁女”土地拆遷補償的不足，從法理層面提出了“外嫁女”土地拆遷補償糾紛的解決對策。……
