法制思維與法制方式管理企業探討

摘 要 近年來，隨著我國社會主義市場經濟的快速發展，人們生活水平不斷提高，法律意識也逐漸增強。法律思維作為一種新型思維，對于現代企業管理具有十分重要的影響，現代企業管理過程中只有具備良好的法律思維，綜合運用實際的法律思維來解決相應的實際問題，才能實現現代企業經濟效益和社會效益的最大化。本文針對法律思維在現代企業管理的現狀以及存在的問題，提出幾點有效的措施和建議，從而提高我國現代企業管理水平，綜合運用法律思維對現代企業進行管理。①

Abstract In recent years， with the rapid development of China's socialist market economy， people's living standards continue to improve， the legal awareness is gradually enhanced. Legal thinking， as a kind of new thinking， for the modern enterprise management has a very important influence， modern enterprise management process， only to have good legal thinking， comprehensive use of the actual legal thinking to solve some practical problems， in order to achieve the maximization of modern enterprise economic benefits and social benefits. In this paper， in view of legal thinking in the modern enterprise management of the status quo and the existing problems， put forward some effective measures and suggestions， so as to improve the management level of modern enterprises in China， comprehensive use of legal thinking of modern enterprise management.

0 引言

企業管理作為整個企業運行中的重要組成部分，在整個企業中起到了維持經營和發展秩序，減少企業風險的作用，能夠使企業達到平衡發展的狀態。在經濟全球化趨勢的影響下，我國企業競爭日益加劇，一個企業要想在激烈的社會主義市場競爭中處于不敗之地，就必須提高現代企業管理的水平，滿足企業的自身經濟利益。因此綜合將法律思維應用于現代企業管理中，利用法律思維來優化現代企業管理，用法律對企業約束企業員工的行為，只有這樣才能使其更好地順應社會的發展。②
