摘 要:新一輪機(jī)構(gòu)改革后,大部分地區(qū)檔案局、館分設(shè),很多檔案館“三定方案”中明確受委托行使行政職能。對(duì)行政委托概念的明晰有助于檔案部門(mén)履行行政職責(zé)。在實(shí)際工作中,委托關(guān)系的運(yùn)作,存在缺乏法律依據(jù)、缺少書(shū)面委托協(xié)議、委托事項(xiàng)不明確、受委托方履職能力未評(píng)估、委托方監(jiān)管職責(zé)缺失等諸多問(wèn)題。針對(duì)這些問(wèn)題,文章建議優(yōu)化檔案法治環(huán)境,簽訂并發(fā)布委托協(xié)議,強(qiáng)化專業(yè)人才培養(yǎng),檔案局統(tǒng)籌行政職能,合法合理履行委托事項(xiàng)的監(jiān)督責(zé)任。

An Analysis on Archives Administrative Entrustment after Institutional Reform

Abstract: After the new round of institutional reform, the regional archives bureaus and archives have been set up separately, and many archives have been clearly entrusted to perform administrative functions in the Sanding scheme. The clarity of the concept of administrative entrustment helps the archives department to perform its administrative duties. In practical works, the operation of the entrustment relationship has many problems, such as lack of legal basis, lack of written entrustment agreement, unclear entrustment matters, failure to evaluate the performance ability of the entrusted party, and lack of supervision responsibilities of the entrusting party. In view of these problems, this paper suggests optimizing the legal environment of archives, signing and issuing entrustment agreements, strengthening the training of professionals, coordinating the administrative functions of the archives bureau, and legally and reasonably performing the supervision responsibility of entrusted matters.

機(jī)構(gòu)改革后,絕大部分地區(qū)檔案局、館分設(shè),黨辦掛檔案局牌子,檔案館成為黨委直屬事業(yè)單位。國(guó)家檔案局局長(zhǎng)陸國(guó)強(qiáng)在全國(guó)檔案局長(zhǎng)館長(zhǎng)會(huì)議上指出,“檔案局的行政職能要聚焦抓規(guī)劃引領(lǐng)、抓監(jiān)督檢查、抓隊(duì)伍建設(shè),有關(guān)業(yè)務(wù)指導(dǎo)工作可以依法依規(guī)委托給檔案館來(lái)做。”[1]實(shí)踐中,很多檔案館“三定方案”中明確受委托行使行政職能,進(jìn)而定為參公單位。這種行政委托關(guān)系在實(shí)際運(yùn)作過(guò)程中,存在諸多問(wèn)題,影響了委托的效果。目前檔案學(xué)界對(duì)檔案行政委托的研究仍處于空白狀態(tài),如何有效開(kāi)展行政委托,讓局、館聯(lián)合產(chǎn)生“1+1>2”的效應(yīng),成為重要的課題。
1 行政委托的理論與實(shí)踐
一些地區(qū)檔案館單獨(dú)設(shè)置后,受檔案局委托行使業(yè)務(wù)指導(dǎo)、行政執(zhí)法等部分行政職能。這種情況下,檔案部門(mén)需要把握行政委托的相關(guān)理論。“檔案主管部門(mén)”是履行檔案行政職能單位的統(tǒng)稱,為表述簡(jiǎn)潔,本文中“檔案局”代指“檔案主管部門(mén)”,“檔案館”代指“國(guó)家綜合檔案館”。……
