湖北省農業環境保護立法情況與體會

摘要：解決農業環境突出問題的關鍵措施之一是健全農業環境保護法律法規體系。湖北省是全國第二個出臺省級農業環境保護條例的省份，同時，圍繞農業資源與環境保護，湖北省進行了一系列實踐探索，在相關地方法規中進行了明確規定，推動了全省農業資源環境保護法制建設。

The Overview and Reflection on Legislation of Agro-environmental

Protection in Hubei Province

Abstract： One of the key countermeasures to solve the prominent problem of agricultural environment is improving the system of laws and regulations of agro-environmental protection. Hubei is the second province that published provincial regulations of agro-environmental protection. In the meantime， centering around protection of agricultural resources and environment， Hubei province carried on a series of practice and exploration， making it clear in relevant local legislation， promoted the legal system construction for protection of agricultural resources and environment in Hubei.

黨的十八屆四中全會首次將依法治國列為會議主題，標志著中國將依法治國、依法行政提高到了前所未有的高度。

隨著中國綜合國力的提高和城鄉人民生活水平的大幅改善，人們對食品安全、農業資源環境保護的要求比以往任何時候都更加嚴格、更加迫切。加強農業資源環境保護立法工作，對于保障國家糧食安全，推動農業和農村經濟可持續發展具有十分重要的戰略意義和現實意義[1]。

1 ?湖北省近年農業資源環境保護立法概況

1.1 ?湖北省農業的戰略地位

湖北省國土面積18.59萬km2，地處長江中下游，素有“千湖之省、魚米之鄉”的美譽。常年可用耕地336.1萬hm2，年均復種指數達到2.28，年投入化肥355萬t，農藥4萬～5萬t。湖北省以全國3%的耕地面積生產了全國8.4%的稻谷、6.3%的棉花、10.3%的油料、5.4%的豬肉和18.0%的淡水水產品，每年為社會提供了大量糧棉油、畜禽及水產品，并為全國4.4%鄉村人口提供了生產和生活空間[2]。2013年，全省糧食總產達到250.13億kg，并首次實現“十連增”。油菜子總產250.45萬t，同比增加20.45萬t，總產連續18年保持全國第一位。……
