摘要：少數(shù)民族非物質(zhì)文化遺產(chǎn)的知識(shí)產(chǎn)權(quán)保護(hù)研究具有重大現(xiàn)實(shí)意義。文章針對(duì)我國少數(shù)民族地區(qū)非物質(zhì)文化遺產(chǎn)傳承面臨的問題和保護(hù)的重大意義，以內(nèi)蒙古地區(qū)為主要考察對(duì)象，從非物質(zhì)文化遺產(chǎn)的概念和特征出發(fā)，對(duì)非物質(zhì)文化遺產(chǎn)保護(hù)的雙重含義、保護(hù)的獨(dú)特性，非物質(zhì)文化遺產(chǎn)知識(shí)產(chǎn)權(quán)保護(hù)的理論基礎(chǔ)、優(yōu)勢(shì)和必要性予以闡釋和論證。在少數(shù)民族地區(qū)非物質(zhì)文化遺產(chǎn)保護(hù)現(xiàn)狀的基礎(chǔ)上，提出少數(shù)民族地區(qū)非物質(zhì)文化遺產(chǎn)知識(shí)產(chǎn)權(quán)保護(hù)的基本原則，為少數(shù)民族地區(qū)非物質(zhì)文化遺產(chǎn)的知識(shí)產(chǎn)權(quán)保護(hù)設(shè)計(jì)一些切實(shí)可行的方案。

Heritage Protection of Ethnic Minority

——Taking Inner Mongolia Area as the Main Study Object

Abstract：It has great realistic significance to research intellectual property protection of the intangible cultural heritage of ethnic minority. This article aims at the inheritance problems and significance of protecting intangible cultural heritage in ethnic minority regions in China, with Inner Mongolia as the main study object. Starting from the concept and characteristic of the intangible cultural heritage, we will explain and demonstrate the double meaning, the uniqueness, the theoretical basis, advantage and necessity of intellectual property protection of intangible cultural heritage. Then we will put forward some general principles to intellectual property protection of intangible cultural heritage in ethnic minority regions on the basis of the current situation. Finally, we will give some feasible solutions to the intellectual property protection of intangible cultural heritage in ethnic minority areas.

由于非物質(zhì)文化遺產(chǎn)保護(hù)問題的特殊性，近些年來其日益成為包括民族學(xué)、法學(xué)、史學(xué)、藝術(shù)學(xué)、醫(yī)學(xué)等多學(xué)科學(xué)者研究的對(duì)象，其中各具特色而又亟待保護(hù)的少數(shù)民族非物質(zhì)文化遺產(chǎn)又是重中之重。非物質(zhì)文化遺產(chǎn)保護(hù)與知識(shí)產(chǎn)權(quán)法之間的內(nèi)在聯(lián)系已引起學(xué)者的關(guān)注和討論，但目前對(duì)該問題無論是立法司法實(shí)踐還是法律理論研究都存在重大不足，這一問題的研究不僅關(guān)涉知識(shí)產(chǎn)權(quán)法理論本身的完善，也符合保護(hù)少數(shù)民族非物質(zhì)文化遺產(chǎn)的現(xiàn)實(shí)要求，具有重大意義。……
