THE RESEARCH OF THE JUSTICIABILITY OF CSR

There exist arguments on whether enterprises should put much emphasis on CSR. This paper will discuss what CSR is and compare the theories and ideas on CSR. Finally， give own option according to the existing problems， especially in the international content， including challenges， problems and suggestions。

We are entering an era where corporate social responsibility （CSR） is of central concern to executives of almost every enterprise.

CSR simply refers to strategies that ensure that corporations or firms conduct their business in a way that is ethical and society-friendly. CSR can involve a range of activities such as working in partnership with local communities， socially sensitive investment， developing relationships with employees， customers and their families， and getting involved in activities for environmental conservation and sustainability.

After entering the 19th century， twice the results of the industrial revolution brought about by the productive force leap in quantity and scale to greater extent on development .this period by the “Social Drawinsm”thought the impact of corporate social responsibility concept is to hold a pessimistic attitude， and not a lot of businesses take the initiative to take up social responsibilities， but with the enterprise is closely related to suppliers and employees the best exploit as soon as possible， into a society of strong competiton， this concept of development with the industry have had a lot of strong negative influence.residents who felt exploited said that too much was spent on enterprise and not enough on social services.

In the 21th century， the socialist market economy system and modern enterprise system are deepening and developing.

After years of intense debate， the issue whether the enterprises should or not remains unresolved.There is a substantial divergence of opinion on such a complex and perplexed issue. Some people believe that the goal of enterprises is to make as big a profit as possible. Enterprises produce products to see the service of the society their highest life problem， which should be deemed as a form of social responsibility.However， some people hold that an enterprise cannot develop without the support of the whole society. So it is a responsibility for enterprises to do something give back to the society inn small ways.

The company should bear social responsibility， which is todays social political and economic environment of the companys general requirements . There is a very good way to achieve corporate social responsibility. In many ways to achieve the company social responsibility， judicialization of corporate social responsibility is undoubtedly the ultimate restricting factors on the realization of the social responsibility of the company.The so-called judicialization of social responsibility is to undertake the corporate social responsibility into judicial rights and obligations， according to the terms and conditions of social responsibility， the judge an referee related case .its moral obligation is the social and political responsibility.The problems on CSR are related to establishing and perfecting the modern corporation system in china.China development bank continued to tilt to its loan policies in favor of the improvement of peoples living standards.more loans have been granted to finance agriculture， rural development， farmers livelihood， small and medium-sized enterprises， housing for the middle-and low-income household， education， health and emergency response.we issued a total of RMB201.5 billion of loans， allowing more urban and rural residents equal access to development financial.

Responsibility is the soul of management， while management is the pillar of responsibility.Focusing on its mission to “increase national strength and improve peoples livelihood”， CDB strengthened its social responsibility management comprehensively in2008 and set about to optimize its management system， so as to lay a solid management and system foundation for full implementation of social responsibility.

In my opinion， theres nothing wrong for an enterprise to seek more profits from the society， but it should never neglect its importance of social responsibilities. The more an enterprise gains from the society， the more welfare it should return to the society. To perform social Responsibilities helps to win The respect of

the society by Setting up a good enterprise image， which will undoubtedly foster the development of the enterprises.the enterprise work together on welfare reform， met to punish the poor but to empower them.welfare and happiness is one thing， economic mission is committed to the welfare， which is devoted to the human happiness.

Good citizenship theory of social responsibility is that， as a company， the organization for the purpose of profit， the company has the responsibility to solve certain social problems.when faced with a danger or a need， company and people should help each other.

Social organization also should take some measures.company could provide consumers with rich， high-quality products and services to meet the diverse needs of consumers and safeguard the interests of consumers .company also should pay attention the protection of the employees labor rights.the company also should compete with other competitions fairly， improve community relation， and maintain market order .the company also should protect the rights of customer and environmentally friendly business are given preference in this search.

The basic contention of this paper is that CSR can become a meaningful instrument in trade law as well as in the enforcement of labor law， but if negatively applied， it can become detrimental to some countries， including china.followed by unfair means for illegal benefits， even at malicious prosecution for means infringe upon the lawful rights and interests of behavior has occurred.legally enforceable liability clauses should also be clearly defined to mitigate any negative result that might occur because a service provider can not perform its responsibility satisfactory

Each individual is related To And Bears obligations To others That Is What We call social responsibility. The sense of social responsibility is very important to us. If everyone has a good sense of social responsibility， we can build a better social and a more prosperous country.we know no nation can meet the challenge and seize the opportunities of the 21th century alone -all of us have to take responsibility and work together .In order to build the harmonious society， and promote the sustainable development of the corporate social responsibility， enterprises need implement corporate social responsibility well.The company should improve the public relationship between company and local community.sometimes， the company could donate money to support a charity.CSR structure can contribute to peoples and mental health， economic growth and employment and construction of material and spiritual civilization.
