A Georgia teenager sues a pair of cyberbullies who created a fake Facebook page of the victim, and filled it with 1 content. Fourteen-year-old Alex Boston discovered the attack when friends asked her about the page.
Her 1)attorney tells CNN why they thought a lawsuit was the best way to fight back.
Natalie Woodward (Alex Boston’s Attorney): We really felt like…that we had an opportunity here to bring attention to the issue, to potentially change the way the issue is handled in schools, and to change the way the issue is handled by the police and the state of Georgia.
According to Ars Technica, Georgia restricts its laws covering cyberbullying between classmates to what happens within the walls of schools.
“In Georgia, schools can punish students if they bully others at school, but the law governing this does not extend to text messages and social media sites.”
But that hasn’t prevented Alex Boston’s attorneys from 2)alleging 3)libelous damage on the part of the bullies. It’s a different strategy than looking the other way: instead, choosing to strike back.
Wired reports on the basis of the suit, “...which accuses the teens of 4)defamation and intentional 5)infliction of emotional distress, and seeks 6)punitive 7)damages. The parents of the 8)defendants are named in the suit because they paid for the Internet access that allowed their children to create the account and post the messages...”
And it’s not just the alleged bullies who could face trouble. ABC News reports, Facebook itself is also named in the suit, after Boston’s family tried to take the fake account down.
“Here’s how you do it. You go to Facebook. If something’s not right, you can click remove. And down at the bottom, you can report it, and mark it as 9)spam. They did this repeatedly, but nothing was done.”
But Above the Law says, this goes 10)beyond the pale. Suing teens for being mean could bring about endless 11)litigation.
“...it’s called growing up. Part of becoming an adult is learning to deal with mean people, and people who just suck as humans. Trying to execute every eighth-grade bully is not going to eliminate adult 12)jerks.

“在喬治亞州,學(xué)校可以對(duì)在校內(nèi)欺負(fù)他人的學(xué)生進(jìn)行懲罰,但法律約束的范圍并不包括手機(jī)短信和社交網(wǎng)站。”
但該法律條文并未阻止亞歷克斯·波士頓的律師以欺凌造成名譽(yù)損害的罪名提起訴訟。與假裝事情沒(méi)有發(fā)生相比,他們選擇了一種不同的策略:反抗。
《連線》雜志對(duì)訴訟的主要內(nèi)容進(jìn)行報(bào)道:“……這兩位青少年被控‘誹謗’和‘故意造成他人精神負(fù)擔(dān)’,并被索賠精神賠償。被告的父母也被告上了法庭,因?yàn)樗麄優(yōu)樽约旱暮⒆又Ц毒W(wǎng)絡(luò)使用費(fèi)用,從而使他們得以創(chuàng)建帳號(hào)并發(fā)布信息……”
美國(guó)廣播公司報(bào)道稱,遭起訴的不僅僅是被指控的網(wǎng)絡(luò)欺凌實(shí)施者。波士頓的家人在試圖撤消虛假帳號(hào)失敗后,將臉譜網(wǎng)網(wǎng)站一并告上了法庭。
“通常情況是這樣。你訪問(wèn)臉譜網(wǎng)網(wǎng)站,發(fā)現(xiàn)有什么不對(duì)勁的,你可以點(diǎn)擊‘刪除’。然后再移至網(wǎng)頁(yè)下端,你點(diǎn)擊‘舉報(bào)’,將其列為垃圾內(nèi)容。
