我國網絡知識產權的現狀與保護分析

摘 要：在經濟社會飛速進步的背景之下，信息產業在經濟發展中已占據了支柱地位。互聯網自身所具備的便捷性、實時性以及共享性特征，促使其被應用于越來越多的領域。本文首先對網絡知識產權的相關內容進行了合理分析，其次對侵權行為的主要表現進行了分析，最后針對侵權行為普遍存在的現狀對相關的網絡知產保護措施進行了完善。

Abstract：Under the background of rapid economic and social progress，the information industry has occupied a pillar position in the economic development. The convenience，real-time and sharing characteristics of internet impel it to be applied to more and more fields. In this paper first analyzes the content of internet intellectual property right. Secondly，the main performance of the tortious conduct is analyzed. Finally，the related network knowledge and production protection measures are perfected according to the current situation of the widespread infringement.

知識產權通常指的是權利人憑借智力活動所創造出的精神產品所享受的專有性權利。對于網絡知識產權來講，其主要指在網路媒介、載體的基礎上所形成的數字信息產權。互聯網自身所具備的便捷性、實時性以及共享性特征，促使其被應用于越來越多的領域。然而，網絡自身就具備不安全性，因此，增強對網絡知識產權的保護十分必要。下面對當下國內網絡知識產權保護及發展狀況進行了詳細探討。

1 網絡知識產權的相關內容

1.1 網絡知識產權的含義、特征

知識產權通常是指人類憑借自身在智力活動及經營管理活動中所創造的信譽、標記而享有的合法權利。在過去，知識產權依賴于特定物質載體而存在，然而，在現代網路技術如此發達的時代，智力成果、以數字化形式而體現的精神成果往往要憑借網絡這一載體而得到廣泛且快速的擴散。眾所周知，基于人類生理特征，其所感知的通常限制在閃爍于計算機終端熒幕上的影像、數據，這些影像、數據一般綜合無地域性、瞬間行、專有性以及無形性等特點于一身。……
