論圖書館數字資源服務的知識產權侵權風險

〔摘 要〕針對圖書館數字資源服務知識產權風險頻發，結合圖書館服務實踐分析了知識產權風險發生的時空點與種類:數據庫服務時的知識產權風險;視頻點播服務時的知識產權風險;數字參考咨詢服務時的知識產權風險#65377;提出了降低#65380;防范知識產權風險的策略:提高知識產權保護意識;加強知識產權管理;依法服務;技術保護等#65377;首次在圖書館界提出數字資源服務時需熟悉合理使用界限，掌握法定許可條件等依法服務的防范知識產權風險發生的建議與策略#65377;

〔Abstract〕To the frequent occurrence of intellectual property risks of library Digital Resource Service.The article analyses its space-time point and types combining with the practice of library service;the intellectual property risks existsin Database services;Video on Demand and Digital Reference Service;It comes up with strategies of lowering and preventing intellectual property risks which includes developing awareness of protecting intellectual property;strength then management of intellectual property，serving in accordance with the law and protecting technologies and so on.Being familiar with fair use of limits and mastering legal suggestions and strategies which prevent intellectual property risks occurring in digital resource report are put forward first time in library community.

圖書館數字資源服務的知識產權風險，指圖書館(創造條件)為用戶提供數字資源服務時，因未履行或未完全履行法定義務而導致知識產權權利人權利受侵害的危險狀態#65377;

在圖書館數字資源服務的不斷拓展與創新之際，其知識產權風險出現的機率也隨著服務量的增加而上升#65377;因而，對圖書館數字資源服務的知識產權風險問題進行探討，有利于圖書館順利地開展數字資源服務工作#65377;
