基于語料庫的otherwise的用法和譯法研究

法律語言是不同于一般語言的法律載體[1]，具有準確和簡潔的特點，要求用詞正式、嚴肅并確切。因此，普通英語詞匯在法律文本中的使用與日常英語有所不同，主要體現在搭配和譯法方面，成為學習難點。本文試圖探討otherwise在《聯合國移民、難民公約英漢平行語料庫》中的用法和譯法。

一、《聯合國移民、難民公約英漢平行語料庫》內容簡介

《聯合國移民、難民公約英漢平行語料庫》為雙語平行語料庫，主要由聯合國簽署的有關移民、難民的法律公約和議定書，中英美等各國移民和難民法規以及國際移民組織有關文獻等組成。語料庫容約為800萬字符，117部法律文件。該語料庫的建成不僅可以豐富國內法律語料庫的建設，還能為學員畢業論文的撰寫和相關專業研究提供一定幫助。

語料庫的研究方法有利于從大量的語料剖析語言的特點[2]。近年來，語料庫已經成為翻譯研究的一個重要手段[3]。本文基于自建的移民、難民法律公約語料庫，運用AntConc軟件，檢索出在本語料庫中所有的otherwise，采用定量分析的方法，探討otherwise在本語料庫中的用法和譯法。

二、otherwise的用法和譯法分析

根據《牛津高階英漢雙解詞典：第6版》的解釋，otherwise是副詞，主要有三個意思：1.used to state what the result would be if sth. did not happen or if the situation were different(否則；不然)； 2.apart from that(除此以外)；3.in a different way to the way mentioned; differently(在其他方面；另；亦)[4]。otherwise在本語料庫中的用法和譯法討論如下。

(一)譯為“除……另有……外”

1.otherwise和unless連用

在本語料庫中，通過使用AntConc軟件統計，發現otherwise總共使用了37次。其中unless和otherwise連用的情況最多，共有8次，后面主要接provided，decided，requested和agreed，其中provided使用最多，共有5次。在這里otherwise的意思和上述牛津詞典解釋中的第三個意思相同，為“in a different way to the way mentioned; differently”(在其他方面；另；亦)。使用的句式為unless+(it is)+otherwise+動詞過去分詞，省略了it is，一般翻譯為“除非另有規定外，除……另有……外”。例如“The provisions of the Convention shall apply, mutatis mutandis, to this Protocol unless otherwise provided herein.”譯為“除非本議定書中另有規定，公約的規定應經適當變通后適用于本議定書?！?出自“Protocol against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition, supplementing the United Nations Convention against Transnational Organized Crime”《聯合國打擊跨國有組織犯罪公約關于打擊非法制造和販運槍支及其零部件和彈藥的補充議定書》)

除了unless和otherwise連用后加動詞過去分詞的用法，還出現了unless...+otherwise直接和動詞連用的情況，動詞放置在otherwise前面或后面，共出現4次。其中兩次分別在“Worst Forms of Child Labour Convention”(《禁止和立即行動消除最惡劣形式的童工勞動公約》)和“Seafarers’ Identity Documents Convention (Revised), 2003 (No. 185)”(《2003年海員身份證件公約》)中，都是以“unless the new Convention otherwise provides”的形式出現，譯為“除新公約另有規定外”。另外一次在“Convention relating to the Status of Stateless Persons”(《關于無國籍人地位的公約》)中，原文“...unless compelling reasons of national security or public order otherwise require...”，譯為“除因國家安全或公共秩序的重大原因應另作考慮外”。還有一次在“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”(《保護所有移徙工人及其家庭成員權利國際公約》)中，“...unless compelling reasons of national security require otherwise...”，譯為“除因國家安全的重大理由另有規定外”。

2.otherwise和except連用

根據統計結果，除unless之外和otherwise搭配使用比較多的是except as，共6次。except as otherwise后面接provided或stated，其中stated使用最多，共有4次。在這里otherwise的意思和上述牛津詞典解釋中的第三個意思相同，為“in a different way to the way mentioned; differently”(在其他方面；另；亦)。這里使用的句式為except+ as +(it is)+otherwise+動詞過去分詞，省略了it is，與unless...+otherwise相似，翻譯為“除……另有規定外”。例如“The present Convention is applicable, except as otherwise provided hereafter, to all migrant workers and members of their families without distinction of any kind such as sex, race, colour, language, religion or conviction, political or other opinion, national, ethnic or social origin, nationality, age, economic position, property, marital status, birth or other status.”譯為“本公約，除此后另有規定外，適用于所有移徙工人及其家庭成員，不分性別、種族、膚色、語言、宗教或信念、政治見解或其他意見、民族、族商或社會根源、國籍、年齡、經濟地位、財產、婚姻狀況、出身或其他身分地位等任何區別?！?出自“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”《保護所有移徙工人及其家庭成員權利國際公約》)

還有一處except和otherwise的搭配，在“Convention relating to the Status of Stateless Persons”(《關于無國籍人地位的公約》)中，原文為“...except where compelling reasons of national security otherwise require...”，譯為“除因國家安全的重大理由要求另作考慮外”，這個用法和上述的unless...+otherwise直接和動詞連用的用法相似，也翻譯為“除……另有……外”。

(二)譯為“否則，不然”

通過統計發現would和otherwise搭配使用的情況也較多，共出現了6次，其中otherwise有5次用在would后面，1次用在would前面。這里otherwise都是做副詞，和上述牛津詞典解釋中的第一個意思相同，表示“否則，不然”。例如“States Parties shall ensure the implementation of these rights in accordance with their national law and their obligations under the relevant international instruments in this field, in particular where the child would otherwise be stateless.”譯為“締約國應確保這些權利按照本國法律及其根據有關國際文書在這一領域所做承諾予以實施，尤應注意不如此兒童即無國籍?！?出自“Convention on the Rights of the Child”《兒童權利公約》)

(三)譯為“或……”，“……或其他……”

本語料庫中，還出現了or otherwise+動詞(包括動詞分詞)的結構，共出現4次，在“The Exit and Entry Administration Law of the People’s Republic of China”(《中華人民共和國出境入境管理法》)中出現2次，在“United Nations Convention against Transnational Organized Crime”(《聯合國打擊跨國有組織犯罪公約及其議定書》)也出現2次，都理解或翻譯為“或……”“或……其他……”。例如“Where foreigners engage in activities not corresponding to the purposes of stay or residence, or otherwise violate the laws or regulations of China, which makes them no longer eligible to stay or reside in China, they may be ordered to exit China within a time limit.”譯為“外國人從事與停留居留事由不相符的活動，或者有其他違反中國法律、法規規定，不適宜在中國境內繼續停留居留情形的，可以處限期出境。”(出自“The Exit and Entry Administration Law of the People’s Republic of China”《中華人民共和國出境入境管理法》)

這里or otherwise的用法和普通用法不同，《牛津高階英漢雙解詞典：第6版》中or otherwise的解釋是“used to refer to sth. that is different from or the opposite of what has just been mentioned”(或其他情況；或相反)。而在本語料庫中or otherwise表示“以其他方式”，因此翻譯時要根據上下文選擇合適的譯法[5]。

(四)譯為“不同，不同于”

還有otherwise和than搭配使用，只出現了一次，在“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”(《保護所有移徙工人及其家庭成員權利國際公約》)中，第2條第2點h點“The term “self-employed worker” refers to a migrant worker who is engaged in a remunerated activity otherwise than under a contract of employment and who earns his or her living through this activity normally working alone or together with members of his or her family, and to any other migrant worker recognized as self-employed by applicable legislation of the State of employment or bilateral or multilateral agreements.”譯為“‘自營職業工人’一詞是指從事非屬雇用合同的有報酬活動，通常是單獨或與其家庭成員共同通過此種活動謀生的移徙工人，以及經就業國適用的立法或雙邊或多邊協定承認為從事自營職業的任何其他移徙工人”。這里otherwise than的意思和other than相似，譯為“不同，不同于”。

(五)譯為“另外”或“以其他方式”

除了上述幾種出現頻率比較多的otherwise的用法，otherwise在本語料庫中的其他用法基本上都是翻譯為“另外”，或“以其他方式”。

例如在“Convention on the Reduction of Statelessness”(《減少無國籍狀態公約》)中，第10條第2點“In the absence of such provisions a Contracting State to which territory is transferred or which otherwise acquires territory shall confer its nationality on such persons as would otherwise become stateless as a result of the transfer or acquisition.”譯為“如無此種條款時，接受移轉領土或以其他方式取得領土之締約國，對因領土之移轉或取得而致非經授與國籍即無國籍者，應授與該國國籍?！?/p>

這里有兩個otherwise，第一個譯為“以其他方式”，第二個是和would搭配，譯為“否則，不然”。

又如在“International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families”(《保護所有移徙工人及其家庭成員權利國際公約》)中，第22條第3點“The decision shall be communicated to them in a language they understand, upon their request where not otherwise mandatory, the decision shall be communicated to them in writing and, save in exceptional circumstances on account of national security, the reasons for the decision likewise stated.”譯為“應以他們所了解的語言將判決傳達給他們，如果沒有另外的強制性規定，經他們要求，應以書面方式將判決傳達給他們，除涉及國家安全的特殊情況外，應說明判決的理由?！边@里的otherwise譯為“另外”。

同樣在“Seafarers’ Identity Documents Convention (Revised), 2003 (No. 185)”(《2003年海員身份證件公約》)中，3.12.3項“...verification, with the passport authority or other competent authority, of the genuineness of the passport or other document produced; where there is reason to doubt the genuineness of the passport, the original should be sent to the authority concerned; otherwise, a copy of the relevant pages may be sent.”譯為“向護照頒發機關或其他主管機關核查護照或所出示的其他證件的真實性；如有理由懷疑護照的真實性，應將原件寄給有關機關；另外，也可寄出有關頁的復印件?！边@里的otherwise譯為“另外”。

三、結束語

綜上所述，在本語料庫中，和otherwise搭配比較多的詞有unless和except，翻譯為“除……另有……外”；除了otherwise和would搭配時翻譯為“否則，不然”，or otherwise譯為“或……”，“或……其他……”，otherwise than的意思和other than相似，譯為“不同，不同于”，其他基本上都是翻譯為“另外”，或“以其他方式”。這和otherwise在《牛津高階英漢雙解詞典：第6版》中的第三種解釋是相符的，表示“in a different way to the way mentioned; differently”(在其他方面；另；亦)。因此，otherwise除了和unless等幾個詞搭配時的譯法是基本固定的，其他譯法和otherwise的普通用法和譯法沒有區別，與詞典第三種釋義相同。otherwise的用法和譯法值得英語研究者和學習者注意，有助于更好地理解英文法律文本中的邏輯關系。注重更多的常用英文法律詞匯的譯法，也有利于英文法律語言的翻譯和學習。
