河南省專利開放許可對策研究

摘 要：【目的】分析河南省專利開放許可制度的現狀以及制度實施過程中存在的主要困境，為河南省專利開放許可工作提供可行性建議。【方法】分析專利開放許可制度的研究背景、特性、意義，梳理專利開放許可制度在全國以及河南省的建設現狀，深刻剖析目前河南省專利開放許可制度的實施困境。【結果】應當推動專利開放許可業務規模與質量雙提升；加大專利轉化人才培養、系統宣傳、培訓力度；加強評估與定價指導；加大信息精準匹配服務力度；深化職務科技成果賦權改革；進一步明確專利開放許可的期限。【結論】推進河南省專利開放許可制度的高效實施，為河南省高水平創新與高質量發展貢獻“河南智慧”。

Research on the Countermeasures of Patent Open License in Henan Province

Abstract：[Purposes] This paper aims to analyze the current situation of the patent open licensing system in Henan Province and the main difficulties in the implementation of the system， and to provide feasible suggestions for the patent open licensing work in Henan Province. [Methods] By analyzing the research background， characteristics and significance of the patent open licensing system， this paper sorts out the construction status of the patent open license system in China and Henan Province， and deeply analyzes the implementation dilemma of the current patent open license system in Henan Province. [Findings] We should promote both the scale and quality of patent open licensing business， increase the training of patent transformation talents， systematic publicity and training， strengthen evaluation and pricing guidance， increase the intensity of information precision matching services， deepen the reform of the empowerment of scientific and technological achievements and further clarify the duration of patent open licensing.[Conclusions] We should promote the efficient implementation of the patent open licensing system in our province， and contribute "Henan wisdom" to the high-level innovation and high-quality development of our province.

0 引言

專利的實施和運用是促進科技創新的力量源泉。2023年，我國各類專利授權總量達364.9萬件，其中河南省各類專利授權總量為10.99萬件。根據2022年國家知識產權局的統計數據顯示，國內有效專利產業化率為 45.0%，作為我國科技創新高地的科研單位與高校，其有效專利產業化率分別為14.3%和3.5%，有效專利許可率更是僅為5.3%和6.5%，大量專利處于“沉睡”狀態，無法體現出應有的價值[1]。2021年6月施行的《專利法》引入了專利開放許可制度，此舉是以市場為導向、促進技術要素市場化配置的創新舉措，可以極大簡化專利許可交易中的信息搜尋流程、降低交易成本及風險，有助于喚醒我國專利市場中的“沉睡專利”，進一步促進科技成果向企業尤其是中小微企業轉化，助力企業升級發展，助推國家科技創新與經濟高質量發展。……
