對農村宅基地“三權分置”改革試點的思考

摘 ? 要 ?農村宅基地的“三權分置”是深化農業農村改革發展、實施鄉村振興戰略的重大創新，是切實提高農民收入、建設美麗新農村的有益探索。中央、省市各級政府高度重視，將其納入改革的實驗范疇。筆者在對婁底市下轄的新化縣維山鄉三聯峒村、水車鎮正龍村，雙峰縣青樹坪鎮歸古村，漣源市楊市鎮板橋村、龍山國有農場等地實地調研的基礎上，通過典型樣本采集、實例分析，提出了農村宅基地“三權分置”改革試點的相關對策建議。

On the basis of field investigation in Santong Village， Shuiche Town， Zhenglong Village， Weishan Township， Weishan Township， Shuangfeng County， Guigu Village， Qingshuping Town， Banqiao Village， Yangshi Town， Longshan State-owned Farm and other places under the jurisdiction of Loudi City， through typical sample collection and case analysis， the author puts forward relevant countermeasures and suggestions for the pilot reform of "separation of powers" in rural residential land.

1 ?研究區概況與調研樣本數據

1.1研究區概況

婁底市位于湘中腹地，轄婁星區、婁底經濟技術開發區和冷水江市、漣源市、雙峰縣、新化縣等兩區兩市兩縣，戶籍人口444.88萬人，其中農村人口為353.56萬人，96.77萬戶。全市共有集體建設用地99萬余畝（6.6萬余公頃），其中農村宅基地89萬余畝（5.93萬余公頃），占集體建設用地90%。近5年來，婁底市平均每年審批宅基地1.7萬余宗，其中原址翻建擴建約占70%，異地選址新建約占30%，戶均住宅面積達160平方米以上，年均約占農用地1200余畝（80余公頃）（其中耕地860余畝（57.3余公頃））、建設用地2800余畝（186.7余公頃）。

1.2調研樣本數據

此次調研選取了五個鄉鎮，以典型村莊作為調研樣本，除楊市鎮的板橋村外，其余各村均有較為活躍的旅游資源。

三聯峒村共有居民844戶共3298人，宅基地總面積為76520平方米，有廢棄宅基地25處，共計3200平方米;

正龍村現有居民681戶共2696人，該村基本農田保護區占所有土地面積的84.1%，該村大力發展鄉村旅游業，按照“公司+村民+基地”方式對相對集中的古民居群落（200余戶）進行保護和經營;

歸古村現有居民490戶，宅基地總面積約為85000平方米，現有廢棄宅基地30處，共5000平方米;現有一戶多宅居民160戶，共多占8000平方米;

板橋村共有居民418戶，1258人，宅基地總面積為33440平方米，現有廢棄宅基地25處，共3200平方米;現有一戶多宅基地的居民15戶，共多占1200平方米。

龍山國有農場作為國家級森林公園規劃面積為9826公頃，實際面積為4100畝（273.3公頃），員工621人，其中在職員工200多人，退休員工400多人。

從“三權分置”視角對現有調研情況進行分析歸納，可知：
