“親生親賣”到底是不是犯罪？

Is “selling own children”"a crime or not？

When starting a life， those children are sold as “commodities”， and the sellers are their own parents， which is more serious than the ordinary child trafficking and infant abandon. "A net friend named “Ri Yu 2015” said， “as a parent， he＼she worries about those children. Sold by own parents， when they grow up， how can they treat the society？ How to interpret this kind of family affection？ What they would do with their life？” However， for a long time， this kind of behavior hovers at the basic problem of guilty or not guilty and what kind of crime it is.

Selling own children can be a crime or not should consider its seriousness and whether it is for seeking profits. The 240th stipulation of Chinese Criminal Law said that， woman and child trafficking is the action for seeking profits， any behavior that related to abducting， kidnaping， bribing， trafficking， and transferring women and children can be crime of woman and child trafficking. So， child trafficking crime is limited to the above six actions and not includes selling own children.

孩子在人生路起步時，就被當做“商品”進行買賣，且賣家還是自己的親生父母，這比普通的拐賣兒童、棄嬰等行為更加惡劣。一位名為“日雨2015”的網友說：“身為父母，為那些孩子擔心，被親生父母所賣，等他們長大，該如何看待這個社會？如何詮釋這種親情？他們的人生該怎么辦？”然而在很長一段時間內，這種行為卻在罪與非罪、定何種罪的基本問題上徘徊。

出賣親生子女是否構成犯罪，主要看情節是否惡劣以及是否以營利為目的。中國刑法第二百四十條規定，拐賣婦女、兒童是指以出賣為目的，有拐騙、綁架、收買、販賣、接送、中轉婦女、兒童行為之一的，即構成拐賣婦女、兒童罪。可見，拐賣兒童罪只限于上述六種客觀行為，并沒有將出賣自己的親生子女列為拐賣兒童罪的范疇。

The second part of the 31st stipulation of Adoption Law said that， “for people who sell own children， the public security department should confiscate the illegal income and impose a fine; if the case constitutes a crime， it shall be investigated for criminal responsibility according to law.” The crime in its legislative intention is for those violating the Criminal Law provisions and being adjusted by the Criminal Law， like offence of abandonment. If it constitutes a crime， even being own child， it still needs to have one of the six actions in the 240th stipulation of Chinese Criminal Law.

中國的收養法第三十一條第二款規定，“出賣親生子女的，由公安部門沒收非法所得，并處以罰款;構成犯罪的，依法追究刑事責任。”其立法本意所講構成的犯罪，是指出賣自己親生子女而觸犯刑法條款的犯罪，是受刑法調整的犯罪，如遺棄罪。若要構成拐賣兒童罪，即使是親生子女，還需具有刑法第二百四十條規定的六種情形之一，才能構成犯罪。
